Aronfeld Trial Lawyers Files Lawsuit on Behalf of Video Voyeurism Victims Onboard Royal Caribbean’s Symphony of the Seas
MIAMI – (December 30, 2024) Aronfeld Trial Lawyers has filed a lawsuit in the U.S. District Court Southern District of Florida Miami Division (CASE NO. 1:24-cv-25089), on behalf of passengers onboard Royal Caribbean’s (RCCL) Symphony of the Seas, who were the victim of video voyeurism by their cabin’s stateroom attendant.
Defendant, ARVIN JOSEPH MIRASOL (“MIRASOL”), an employee of Royal Caribbean was assigned by RCCL to serve as stateroom attendant for the Plaintiffs’ cabins. During the subject cruises (ranging from December 1, 2023- February 26, 2024), Mirasol taped a video camera containing a memory card in the Plaintiffs’ passenger cabin bathrooms, capturing images of the Plaintiffs while undressing and engaging in private activities, without their knowledge or consent.
Mirasol later revealed that he had been placing cameras in the cabin stateroom bathrooms since he started working on Symphony of the Seas, around December 2023. Mirasol also stated that while the guests were taking a shower, he would enter the rooms and hide under the bed while recording them naked with his cellular device.
“The fact that many of the victims we represent still do not know if and how their images have been used or circulated is incredibly disturbing. Some of the plaintiffs are children – and once an image is on the internet it is there forever,” said Plaintiffs’ attorney Spencer Aronfeld.
“We hope that RCCL will take full responsibility for the heinous and reprehensible conduct of its crewmember. And we hope that this lawsuit will motivate RCCL and the other major cruise lines to spend more effort screening their crewmembers so that this type of assault never happens again,” Aronfeld continued.
Mirasol, a citizen of the Republic of the Philippines, was recently convicted by the United States for acts related to this matter and was sentenced to 30 years in prison.
In this case, for approximately 12 cruises, Mirasol committed sexual assaults through video voyeurism on various passengers, including the Plaintiffs, who were assigned to cabins for which Mirasol served as stateroom attendant.
An RCCL stateroom attendant is assigned to a section of 16 to 20 passenger cabins, which sleeps 2 to 4 passengers. Thus, Mirasol’s total number of victims may include up to 960 passengers (i.e. – 12 cruises; times up to 20 passenger cabins; times up to 4 passengers per cabin; equals up to 960 passengers).
As a result of RCCL’s breach of the implied covenant of good faith and fair dealing in the passenger ticket contract between RCCL and the Plaintiffs, the Plaintiffs did not discover their injuries in time to provide notice to RCCL and file suit against RCCL and MIRASOL within the contractually shortened time limits provided by RCCL.
The Plaintiffs in this case have suffered physical pain, mental anguish, loss of enjoyment of life, post-traumatic stress disorder, and other mental and nervous disorders. These injuries are permanent and continuing in nature. We demand a judgment for all damages recoverable under the law, including punitive damages, and a trial by jury.
